THIS DESCRIBES THE BILLING AND CANCELLATION POLICY OF EPHARMACIES.COM AND THEIR RESPECTIVE OWNERS AS WELL AS YOUR RIGHTS AND RESPONSIBILITIES. PLEASE READ IT CAREFULLY. PRIOR TO REGISTERING FOR AN ACCOUNT WITH EPHARMACIES.COM Y0U AGREE TO THE BILLING/CANCELLATION POLICY AS OUTLINED BELOW:

EPHARMACIES.COM Billing/Cancellation Policy

By accessing any areas of this site ("Site"), users ("Users" or "you") agree to be legally bound and to abide by this Billing/Cancellation Policy otherwise referred to as. If you do not agree with any part of these BILLING/CANCELLATION POLICY, YOU MUST NOT USE EPHARMACIES.COM.

I HAVE READ THIS AGREEMENT AND HAVE AGREED TO ALL OF THE PROVISIONS CONTAINED WITHIN IT. I UNDERSTAND THAT I CANNOT REGISTER FOR EPHARMACIES.COM’S SERVICE WITHOUT ACCEPTING TO BE BOUND BY ALL OF THE PROVISIONS CONTAINED WITHIN THEIR BILLING AND CANCELLATION POLICY WHICH IS LISTED FOR MY REFERENCE BELOW.

General: EPHARMACIES.COM bills you through an online account (your "Billing Account") for use of the Service. You agree to pay EPHARMACIES.COM all charges at the prices then in effect for any use of the Service by you or other persons (including your agents) using your Billing Account, and you authorize EPHARMACIES.COM to charge your chosen payment provider (your "Payment Method") for the Service. You agree to make payment using that selected Payment Method. EPHARMACIES.COM reserves the right to correct any errors or mistakes that it makes even if it has already requested or received payment.

Recurring Billing: All subscription plans to the Service consist of an initial period, for which there is a onetime charge, followed by recurring period charges as agreed to by you. By entering into this Agreement, you acknowledge that your subscription has an initial and recurring payment feature and you accept responsibility for all recurring charges prior to cancellation. EPHARMACIES.COM MAY SUBMIT PERIODIC CHARGES (E.G., MONTHLY, QUARTERLY, OR YEARLY) WITHOUT FURTHER AUTHORIZATION FROM YOU, UNTIL YOU PROVIDE PRIOR NOTICE (CONFIRMED IN WRITING UPON REQUEST BY EPHARMACIES.COM) THAT YOU HAVE TERMINATED THIS AUTHORIZATION OR WISH TO CHANGE YOUR PAYMENT METHOD. SUCH NOTICE WILL NOT AFFECT CHARGES SUBMITTED BEFORE EPHARMACIES.COM REASONABLY COULD ACT. TO TERMINATE YOUR EPHARMACIES.COM MEMBERSHIP AND PREVENT ANY FUTURE CHARGES ON YOUR BILLING ACCOUNT WITH OUR COMPANY PLEASE VISIT: http://www.epharmacies.com/cancel

Membership Term Switching: All sales which take place on EPHARMACIES.COM are non-transferable! This means that if you sign up for a 90-day EPHARMACIES.COM Membership and then decide you instead want a 30-day EPHARMACIES.COM Membership, you understand EPHARMACIES.COM will NOT honor ANY such request. You understand prior to signing up for ANY EPHARMACIES.COM Membership Plan that the EPHARMACIES.COM Membership Plan which you select at the time or your original transaction will remain the same until you have successfully cancelled your EPHARMACIES.COM Membership. For example, you sign up for a 90-day EPHARMACIES.COM Membership Plan at the rate of $49.97 every 90 days and then decide you would prefer to have a 30-day EPHARMACIES.COM Membership Plan at the rate of $29.97 every 30 days instead, EPHARMACIES.COM will NOT honor this type of request!

Current Information Required: YOU MUST PROVIDE CURRENT, COMPLETE AND ACCURATE INFORMATION FOR YOUR BILLING ACCOUNT. YOU MUST PROMPTLY UPDATE ALL INFORMATION TO KEEP YOUR BILLING ACCOUNT CURRENT, COMPLETE AND ACCURATE (SUCH AS A CHANGE IN BILLING ADDRESS, CREDIT CARD NUMBER, OR CREDIT CARD EXPIRATION DATE), AND YOU MUST PROMPTLY NOTIFY EPHARMACIES.COM and EPHARMACIES.COM IF YOUR PAYMENT METHOD IS CANCELED (E.G., FOR LOSS OR THEFT) OR IF YOU BECOME AWARE OF A POTENTIAL BREACH OF SECURITY, SUCH AS THE UNAUTHORIZED DISCLOSURE OR USE OF YOUR USER NAME OR PASSWORD. CHANGES TO SUCH INFORMATION CAN BE MADE BY CONTACTING CUSTOMER SERVICE OR EPHARMACIES.COM SUPPORT. IF YOU FAIL TO PROVIDE EPHARMACIES.COM ANY OF THE FOREGOING INFORMATION, YOU AGREE THAT EPHARMACIES.COM MAY CONTINUE CHARGING YOU FOR ANY USE OF THE SERVICE UNDER YOUR BILLING ACCOUNT UNLESS YOU HAVE TERMINATED YOUR SUBSCRIPTION FOR THE SERVICE (CONFIRMED BY YOU IN WRITING UPON REQUEST BY EPHARMACIES.COM).

Payment Method: The terms of your payment will be based on your Payment Method and may be determined by agreements between you and the financial institution, credit card issuer or other provider of your chosen Payment Method (the "Payment Method Provider"). If EPHARMACIES.COM does not receive payment from your Payment Method Provider, you agree to pay all amounts due on your Billing Account upon demand. If EPHARMACIES.COM does not receive payment from you in a timely manner your account may be terminated without prior notice. Notice shall be deemed given upon account termination.

Change in Amount Authorized: If the amount to be charged to your Billing Account varies from the amount you preauthorized (other than due to the imposition or change in the amount of state sales taxes), you have the right to receive, and EPHARMACIES.COM shall provide, notice of the amount to be charged and the date of the charge at least 10 days before the scheduled date of the transaction. Any agreement you have with your Payment Method Provider will govern your use of your Payment Method. You agree that EPHARMACIES.COM may accumulate charges incurred and submit them as one or more aggregate charges during or at the end of each billing cycle.

Auto-renewal: Your EPHARMACIES.COM subscription will be automatically extended for successive renewal periods of the same duration as the subscription term originally selected, at the then-current non-promotional subscription rate. To change or resign your subscription at any time visit: http://www.epharmacies.com/cancel. If you resign, you may use your subscription until the end of your then-current subscription term; your subscription will not be renewed after your then-current term expires. However, you won't be eligible for a prorated refund of any portion of the subscription fee paid for the then-current subscription period.

Reaffirmation of Authorization: Your non-termination or continued use of the Service reaffirms that EPHARMACIES.COM is authorized to charge your Payment Method. EPHARMACIES.COM may submit those charges for payment and you will be responsible for such charges. This does not waive EPHARMACIES.COM’s right to seek payment directly from you. Your charges may be payable in advance, in arrears, per usage, or as otherwise described when you initially subscribed to the Service.

Failure to Access Service: You agree that EPHARMACIES.COM is not responsible for your inability to log-on to the Service, either because of poor Internet connections, incorrect typing of usernames or passwords, and/or browser incompatibility. We will make every effort to ensure that our servers remain operational with adequate performance and response time. However, there may be times when our servers are down or response time is slow due to power outages, network problems, regular maintenance, or high traffic volume periods. You agree that neither we, nor our suppliers, are responsible or liable, for any loss or damage caused by your inability to use or access the Service, whether or not caused in whole or part by our negligence.

Indemnification; Governing Law; Jurisdiction: You agree to defend, indemnify, and hold us, our employees, and other representatives harmless from and against all liabilities, damages, claims, actions, costs, expenses (including attorneys fees), in connection with or arising from your breach of this Agreement.

This Agreement is personal to you, and you may not assign your rights or obligations to anyone. If any provision of this Agreement is invalid or unenforceable under applicable law, the remaining provisions will continue in full force and effect. This Agreement shall be deemed to have been made in the State of Texas, and shall be governed by the laws of the State of Texas. The parties expressly stipulate to jurisdiction in Austin, Texas.
