By accessing any areas of this site ("Site"), users ("Users" or "you") agree to be legally bound and to abide by this Electronic Signature Policy otherwise referred to as (ESP). If you do not agree with any part of this ESP, YOU MUST NOT USE EPHARMACIES.COM.
I HAVE READ THIS AGREEMENT AND HAVE AGREED TO ALL OF THE PROVISIONS CONTAINED WITHIN IT. I UNDERSTAND THAT I CANNOT REGISTER FOR EPHARMACIES.COM’S SERVICE WITHOUT ACCEPTING TO BE BOUND BY ALL OF THE PROVISIONS CONTAINED WITHIN THEIR ELECTRONIC SIGNATURE POLICY WHICH IS LISTED FOR MY REFERENCE BELOW.
General: EPHARMACIES.COM requires the successful validation of ALL new members’ electronic signatures. EPHARMACIES.COM has started collecting electronic signatures in efforts of eliminating and reducing potential fraud from being committed anywhere on our website.
EPHARMACIES.COM requires all new members to provide us with their electronic signature and agree to our website's Terms of Service prior to their ability to access and/or use our Service. If you do NOT provide EPHARMACIES.COM with your electronic signature you understand that you will NOT possess the ability to access and/or use our Service. EPHARMACIES.COM collects and validates electronic signatures by way of a computer mouse.
Disclosure of Electronic Signatures: EPHARMACIES.COM reserves the right to disclose ANY member's electronic signature in the event a 'chargeback' is incurred by our company. EPHARMACIES.COM will NEVER disclose ANY member's electronic signature UNLESS a member's already-collected EPHARMACIES.COM membership fee is 'reversed' out of our financial institution(s), as a result of a 'chargeback'. In the event ANY 'chargeback' is incurred by our company, EPHARMACIES.COM’s Risk Management Department will build a 'Chargeback Dispute Case File' which WILL contain the member's electronic signature and WILL be disclosed to select third-parties before, during or after what is often referred to as a 'Chargeback Rebuttal Process'.
Proof of Purchase: On June 30, 2000, President Clinton signed into law the Electronic Records and Signatures in Commerce Act (or Electronic Signatures Act). The president signed the act both electronically and using the more traditional pen-and-ink. The Electronic Signatures Act (Public Law No: 106-229) went into effect on October 1, 2000 and gives electronic contracts the same weight as those executed on paper.
Indemnification; Governing Law; Jurisdiction: You agree to defend, indemnify, and hold us, our employees, and other representatives harmless from and against all liabilities, damages, claims, actions, costs, expenses (including attorneys fees), in connection with or arising from your breach of this Agreement.
This Agreement is personal to you, and you may not assign your rights or obligations to anyone. If any provision of this Agreement is invalid or unenforceable under applicable law, the remaining provisions will continue in full force and effect. This Agreement shall be deemed to have been made in the State of Texas, and shall be governed by the laws of the State of Texas. The parties expressly stipulate to jurisdiction in Austin, Texas.
