General: The EPHARMACIES.COM Refund Policy is in place due to an increasing abuse of credit card “chargebacks” and “theft of information” currently taking place over the Internet.

EPHARMACIES.COM’s Refund Policies, Guidelines and Procedures helps to protect our company from individuals which attempt to use our members-only Service to learn which of our partner pharmacies offer which medications and at what prices, then cancel their EPHARMACIES.COM Membership and expect to be refunded. This is unacceptable considering they now know which of our partner pharmacies offers their desired medication and at what prices.

Please understand that EPHARMACIES.COM DOES NOT offer consumers a FREE Service. Any Refund Requests similar to the examples provided for your reference below are 100% unacceptable and WILL NOT result in your EPHARMACIES.COM Membership fee(s) being refunded. In the event your are requesting a refund for ANY reasons similar to the examples provided for your reference below, we recommend cancelling your EPHARMACIES.COM Membership immediately to AVOID any future charges on your Billing Account with our company. Please understand that PRIOR to registering for ANY EPHARMACIES.COM Membership Plan, you agree that you have READ and UNDERSTAND all our web site's Policies including without limitation to: Terms of Service, Billing/Cancellation Policy, Refund Policy, Electronic Signature Policy, and Service Description. Prior to clicking ANY "CONTINUE WITH REGISTRATION" or 'SUBMIT TO JOIN' buttons which are located on EPHARMACIES.COM’s Registration pages it clearly states, "Prior to registering for EPHARMACIES.COM’s Service you acknowledge and confirm that you have read and agreed to all of our policies below. Failure to Provide Valid Prescription: If you are requesting a refund due to that fact that you were unsuccessful in ordering your desired medication because you were unable to provide EPHARMACIES.COM’s partner pharmacy, in which you attempted to conduct your business with, a valid and existing prescription from your local physician your Refund Request will be DENIED.

You should also be aware of the fact that ALL of EPHARMACIES.COM’s partner pharmacies included in the EPHARMACIES.COM members-only section DO require valid and existing prescriptions before ANY prescription medication orders can be placed and/or accepted. If you do not have a valid and existing prescription, you will NOT be able to order ANY prescription medication(s) from ANY of EPHARMACIES.COM’s partner pharmacies. If you do not have a valid and existing prescription EPHARMACIES.COM suggests scheduling a visit to your local doctor or physician. EPHARMACIES.COM does NOT recommend registering for ANY EPHARMACIES.COM Membership Plan unless you have a valid and existing prescription for the medication(s) you may want to purchase from ANY of our partner pharmacies.

Misconception of Services Rendered: If you are requesting a refund on the basis that you thought you were ordering prescription medication(s) directly from EPHARMACIES.COM and not EPHARMACIES.COM’s partner pharmacies, your Refund Request will be DENIED.

You understand EPHARMACIES.COM is not a pharmacy and does not sell any medication itself. EPHARMACIES.COM is however the leading prescription drug cost comparison site available online today for only Pharmacy Checker Approved Pharmacies. We ensure our members quick and easy access to the cheapest prescription prices available from 100% legal, FDA compliant pharmacies.

Lack of Permission or Knowledge of Membership Auto-Renewal: If you are requesting a refund due to the fact that you were NOT aware of ANY 'Automated Membership Renewals' which might have taken place on your Billing Account with our company, your Refund Request will be DENIED.

All subscription plans to the Service consist of an initial period, for which there is a onetime charge, followed by recurring period charges as agreed to by you. By entering into this Agreement, you acknowledge that your subscription has an initial and recurring payment feature and you accept responsibility for all recurring charges prior to cancellation. EPHARMACIES.COM MAY SUBMIT PERIODIC CHARGES (E.G., MONTHLY or QUARTERLY) WITHOUT FURTHER AUTHORIZATION FROM YOU, UNTIL YOU PROVIDE PRIOR NOTICE (CONFIRMED IN WRITING UPON REQUEST BY RXPOP.COM) THAT YOU HAVE TERMINATED THIS AUTHORIZATION OR WISH TO CHANGE YOUR PAYMENT METHOD. SUCH NOTICE WILL NOT AFFECT CHARGES SUBMITTED BEFORE EPHARMACIES.COM REASONABLY COULD ACT. TO TERMINATE YOUR EPHARMACIES.COM MEMBERSHIP AND PREVENT ANY FUTURE CHARGES ON YOUR BILLING ACCOUNT WITH OUR COMPANY PLEASE VISIT: http://www.EPHARMACIES.COM/cancel

Your EPHARMACIES.COM subscription will be automatically extended for successive renewal periods of the same duration as the subscription term originally selected, at the then-current non-promotional subscription rate. To change or resign your subscription at any time visit: http://www.EPHARMACIES.COM/cancel.

If you resign, you may use your subscription until the end of your then-current subscription term; your subscription will not be renewed after your then-current term expires. However, you won't be eligible for a prorated refund of any portion of the subscription fee paid for the then-current subscription period.

Your non-termination or continued use of the Service reaffirms that EPHARMACIES.COM is authorized to charge your Payment Method. EPHARMACIES.COM may submit those charges for payment and you will be responsible for such charges. This does not waive EPHARMACIES.COM’s right to seek payment directly from you. Your charges may be payable in advance, in arrears, per usage, or as otherwise described when you initially subscribed to the Service.

Accidental Registration Error: If you are requesting a refund due to the fact that you accidently signed up for your EPHARMACIES.COM Membership, your Refund Request will be DENIED.

EPHARMACIES.COM does not accept 'accidental signup errors' as an excuse or reason which will result in your EPHARMACIES.COM Membership fee being refunded.

With that said, it is important that you understand EPHARMACIES.COM identifies, monitors and tracks your computer's unique IP Address while on our web site. This tracking includes your access and use of our members-only Service.

EPHARMACIES.COM has developed and is abiding by the following IP Address Usage Policy.

EPHARMACIES.COM will not disclose any of its web site visitor's unique IP addresses, unless a fraudulent "chargeback" is incurred by our company, EPHARMACIES.COM. In the event a fraudulent "chargeback" is incurred, EPHARMACIES.COM and their respective owners’ Risk Management and Legal Teams, reserve the right to disclose any individual's unique IP address which is responsible for any such fraudulent activity.

Please understand that all third-parties in which EPHARMACIES.COM may share unique IP addresses with adhere to and abide by their own Privacy Policies. EPHARMACIES.COM will only disclose unique IP addresses during a "chargeback" rebuttal, recovery or prevention process.

Early Cancellation of Membership: If you are requesting a refund due to the fact that you cancelled your EPHARMACIES.COM Membership moments after signing up and you are claiming that EPHARMACIES.COM’s Services were of no use or benefit to you, please understand your Refund Request will be DENIED.

No Membership cancellation entitles ANY User of our members-only Service to a REFUND. A Membership cancellation ONLY prevents ANY future charges on a User's Billing Account with our company from occurring. Upon successful Membership cancellation the Users will continue to receive unlimited access to our members-only Service until their original Membership Term has expired.

Underage Minor Conducted Transaction: If you are requesting a refund because you are claiming an underage child was responsible for your transaction your Refund Request will be DENIED.

EPHARMACIES.COM only provides its Service to Users who are at least 18 years of age. If you are not at least 18 years of age you cannot use EPHARMACIES.COM’s Service.

Prior to registering for ANY EPHARMACIES.COM Membership you hereby affirm, under the penalties of perjury pursuant to Title 28 U.S.C. - 1746 that you are currently over the age of 18 years old. You also agree that this transaction is governed by the Electronic Signatures in Global and National Commerce Act (E-Sign Act), 15 U.S.C. - 7001, et seq.

This information is provided in an effort to comply with the Child Online Protection Act (COPA) and related state law. Providing a false declaration under the penalties of perjury is a criminal offense. This document constitutes an un-sworn declaration under federal law. You may submit a paper copy of this transaction and print this form for your personal records.

EPHARMACIES.COM will not be held liable for issuing refunds to ANY User which claims their underage child signed up for our Service.

Membership Term Switching: If you are requesting a refund because you signed up for a 90-day EPHARMACIES.COM Membership Plan and want to downgrade to a 30-day EPHARMACIES.COM Membership Plan, your Refund Request will be DENIED.

All sales which take place on EPHARMACIES.COM are non-transferable! This means that if you sign up for a 90-day EPHARMACIES.COM Membership and then decide you instead want a 30-day EPHARMACIES.COM Membership, you understand EPHARMACIES.COM will NOT honor ANY such request. You understand prior to signing up for ANY EPHARMACIES.COM Membership Plan that the EPHARMACIES.COM Membership Plan which you select at the time or your original transaction will remain the same until you have successfully cancelled your EPHARMACIES.COM Membership. For example, you sign up for a 90-day EPHARMACIES.COM Membership Plan at the rate of $49.97 every 90 days and then decide you would prefer to have a 30-day EPHARMACIES.COM Membership Plan at the rate of $29.97 every 30 days instead, EPHARMACIES.COM will NOT honor this type of request!

If you wish to downgrade your 90-day EPHARMACIES.COM Membership Plan we recommend cancelling it and then after it expires simply sign up for a 30-day Membership Plan at that time. This is the acceptable form of Membership Term Switching EPHARMACIES.COM allows.

Lost or Stolen Credit Card: If you are requesting a refund because your credit card was lost and/or stolen and you are claiming that you were not responsible for the transaction which took place on EPHARMACIES.COM, your Refund Request will be DENIED.

EPHARMACIES.COM is a proud member of Verified by Visa and MasterCard SecureCode. Verified by Visa and MasterCard SecureCode protects MasterCard’s and/or Visa cards with a password only authorized cardholders can create, giving them reassurance that only THEY can use their MasterCard and/or Visa cards when making purchases anywhere over the Internet.

EPHARMACIES.COM also utilizes geo IP tracking solutions which allow our Risk Management Department the ability to cross-reference your ISP's (Internet Service Provider's) geographic location with the geographic location of the computer which you used when conducting your original transaction on our web site. We may also be able to prove that your unique email address coordinates with that of your ISP (Internet Service Provider).

Authorization of Transaction: If you are requesting a refund because you are claiming that you did not authorize the transaction or agree to our web site's TOS (Terms of Service) your Refund Request will be DENIED.

General: EPHARMACIES.COM requires the successful validation of ALL new members’ electronic signatures. EPHARMACIES.COM has started collecting electronic signatures in efforts of eliminating and reducing potential fraud from being committed anywhere on our web site.

EPHARMACIES.COM requires all new members to provide us with their electronic signature and agree to our website's Terms of Service prior to their ability to access and/or use our Service. If you do NOT provide EPHARMACIES.COM with your electronic signature you understand that you will NOT possess the ability to access and/or use our Service. EPHARMACIES.COM collects and validates electronic signatures by way of a computer mouse.

Disclosure of Electronic Signatures: EPHARMACIES.COM reserves the right to disclose ANY member's electronic signature in the event a 'chargeback' is incurred by our company. EPHARMACIES.COM will NEVER disclose ANY member's electronic signature UNLESS a member's already-collected EPHARMACIES.COM membership fee is 'reversed' out of our financial institution(s), as a result of a 'chargeback'. In the event ANY 'chargeback' is incurred by our company, EPHARMACIES.COM’s Risk Management Department will build a 'Chargeback Dispute Case File' which WILL contain the member's electronic signature and WILL be disclosed to select third-parties before, during or after what is often referred to as a 'Chargeback Rebuttal Process'.

Proof of Purchase: On June 30, 2000, President Clinton signed into law the Electronic Records and Signatures in Commerce Act (or Electronic Signatures Act). The president signed the act both electronically and using the more traditional pen-and-ink. The Electronic Signatures Act (Public Law No: 106-229) went into effect on October 1, 2000 and gives electronic contracts the same weight as those executed on paper.

EPHARMACIES.COM’s dedicated server logs can determine that a User has successfully gained access to our members-only Service by logging into our members-only section. EPHARMACIES.COM can also determine how many times a User has successfully logged into our members-only section and for exactly what lengths of time a User was logged in for and when.

Therefore, it is our right and duty to fight for FULL REVERSAL of ANY fraudulent 'chargeback' our company may incur.

EPHARMACIES.COM WILL NOT tolerate ANY form(s) of 'online fraud', especially those dealing with a subject as sensitive as 'prescription drug acquisition' and 'access to affordable healthcare over the Internet'; which are solely intended for legitimate patients, which DO POSSESS valid and existing prescriptions, prior to their attempts to purchase ANY prescription drug(s) over the Internet.

EPHARMACIES.COM’s Risk Management Department understands that no matter how many steps they may take to prevent fraudulent 'chargeback’s' from occurring on our website, they can never prevent them all. With that said, EPHARMACIES.COM’s Risk Management Department is fully prepared for the worst case scenario, which is when a User of our members-only Service claims they 'do not recognize' or 'did not authorize' the charge placed on their credit card or bank statement by our company, Mission City Media, Inc.

EPHARMACIES.COM is prepared to fight for FULL REVERSAL of ANY fraudulent 'chargeback' our company may incur. Upon notification of ANY fraudulent 'chargeback', EPHARMACIES.COM’s Risk Management Department will immediately begin a timely process of organizing a detailed 'Case File' which will be filed against ANY individual which initiates ANY such fraudulent 'chargeback' against our company.

EPHARMACIES.COM’s Risk Management Department has a ZERO toleration-level for ANY form(s) of credit card fraud which may be committed on our web site!

Indemnification; Governing Law; Jurisdiction: You agree to defend, indemnify, and hold us, our employees, and other representatives harmless from and against all liabilities, damages, claims, actions, costs, expenses (including attorneys fees), in connection with or arising from your breach of this Agreement.

This Agreement is personal to you, and you may not assign your rights or obligations to anyone. If any provision of this Agreement is invalid or unenforceable under applicable law, the remaining provisions will continue in full force and effect. This Agreement shall be deemed to have been made in the State of Texas, and shall be governed by the laws of the State of Texas. The parties expressly stipulate to jurisdiction in Austin, Texas.

* Client understands that Company does not tolerate fraudulent "chargeback’s" and will proceed to collect by any means necessary.
* Client is responsible for attorney's fees, fees for collection agencies or third party intervention if client fraudulently charges back or does not pay monies owed to our Company.
* If Client charges back fraudulently, client will owe $500 plus chargeback fees plus amount owed.
* Company will report any outstanding balances to the three main credit bureaus including Equifax, Experian and Trans Union.
* Company will have the incident reported to various Anti-Fraud Databases, which will attempt to prevent any future purchases on the Internet made on Client's behalf, when using the same form of payment which was used by Client on Company's website, http://www.EPHARMACIES.COM
* Company has a Risk Management and Legal Team and will file suit on Client if and when necessary.

EPHARMACIES.COM Membership Cancellation Policies, Requirements and Responsibilities

Please understand that it is 100% YOUR responsibility to CANCEL your EPHARMACIES.COM membership to AVOID any future charges on your account with our company. If you fail to CANCEL your EPHARMACIES.COM membership prior to its automated renewal date, you WILL BE charged your initial membership fee upon its automated renewal date, UNLESS you have successfully cancelled your EPHARMACIES.COM membership.
